Terms of Service
These Terms of Service govern your access to and use of ClearChimney’s services in Canada. By acknowledging these terms, you confirm you have read, understood, and agree to be bound by them.

1. Services
We provide chimney cleaning, inspections, repairs, and related services subject to availability. Service scope is defined during booking and may be adjusted on-site to address safety or code issues.
- Cleaning: removal of soot and creosote to standards appropriate to your system type.
- Inspections: visual or camera-assisted assessments with documented findings when applicable.
- Repairs: minor remediation on-site or scheduled work for larger projects when approved.
2. Booking & Cancellation
You can reschedule or cancel up to 24 hours before the appointment without fees. Cancellations or missed access within 24 hours may incur a call-out fee.
- We will provide a time window and notify you of delays due to weather or safety conditions.
- If unsafe conditions are present, we may postpone or refuse service without liability.
- Any pre-paid amounts for postponed service remain as credit unless a refund is requested per policy.
3. Liability
We are not liable for pre-existing conditions or code violations discovered during service. Our liability is limited to the amount paid for the specific service rendered.
- We do not warrant systems that are improperly installed or beyond safe operating life.
- Photographic documentation may be taken to evidence conditions; see Privacy for handling.
- Indirect or consequential damages are excluded to the extent permitted by applicable law.
4. User Responsibilities
- Ensure safe access to the appliance and roof where needed.
- Disclose known issues, code notices, or prior repairs that may affect service.
- Secure pets and clear work areas of valuables and debris.
- Operate the system only as recommended by the manufacturer and authorities having jurisdiction.
5. Payment
- Payment is due upon completion unless otherwise agreed at booking.
- Additional work outside the quoted scope requires your approval and may be billed separately.
- Unpaid balances may accrue interest as permitted by law and may be sent to collections.
6. Warranties
- Workmanship warranty, where applicable, is limited and excludes normal wear or misuse.
- Manufacturer warranties on parts are subject to their terms and claims processes.
7. Safety & Access
- We follow safety standards and may refuse work if conditions are unsafe.
- Weather, roof pitch, and structural integrity may limit service methods or timing.
8. Privacy
We collect only the data necessary to deliver services and manage bookings. Photos and inspection notes are used to document conditions and recommendations and are retained for a reasonable period.
9. Dispute Resolution
- Contact us to address concerns promptly; we aim to resolve issues amicably.
- These terms are governed by the laws of the province where service is rendered and applicable federal law.
- Claims must be brought within one year of the event giving rise to the claim where permitted.
10. Changes & Contact
We may update these terms to reflect operational or legal changes. Updated terms are effective upon posting. If material changes reduce your rights for a booked service, you may cancel without penalty before the appointment.
